Bombay High Court Sets Fixed Payouts and 48-Hour Repair Mandate on Potholes

Overview

  • Families of those who die due to potholes or open manholes will get Rs 6 lakh, with Rs 50,000–2.5 lakh for injuries based on severity.
  • Compensation must be paid by the responsible authority within six to eight weeks, then recovered from errant officers, engineers or contractors with interest for delays.
  • District-level committees, including the civic chief and the District Legal Services Authority, will identify victims, decide claims and monitor recovery.
  • All reported potholes must be repaired within 48 hours, failing which departmental action will be initiated and negligent officials face penal measures including blacklisting and prosecution.
  • The court affirmed safe roads as part of the right to life under Article 21 and scheduled a compliance hearing for November 21 with reports due from agencies such as BMC, MMRDA, MSRDC, MHADA, BPT, NHAI and PWD.
