Bombay HC Questions Legality of 33-Acre Cuffe Parade SRA Redevelopment

Affidavits are due within 10 days before a further hearing on October 15.

Overview

  • The division bench said diverting prime state land for private redevelopment under the SRA could be a fraud on the Constitution and harmful to public interest.
  • The Ministry of Defence has not granted an NOC due to proximity to defence establishments, and the court directed that the Centre be heard on security implications.
  • Judges asked the state to disclose whether cabinet or collector-level approval exists for transferring such government land and sought assistance from the Advocate General.
  • Affidavits were ordered from the MoD, the SRA CEO, and Maharashtra’s principal secretaries for Urban Development and Revenue, with the matter adjourned to October 15.
  • About 65,000 encroachers are on the tract, with petitions led by Gulab Shankar Mishra and developer Precaution Properties, as the court reiterated that rehabilitation rights do not guarantee housing on the same prime site.
