Bombay HC Declines to Quash FIR Over Pune Student’s Operation Sindoor Repost

The bench said remorse or academic success cannot justify terminating the case at this stage, seeking the prosecution’s case diary for review.

Overview

  • Chief Justice Shree Chandrashekhar and Justice Gautam Ankhad called the charges serious and said deletion of the post, an apology or being a bright student are not grounds to quash the FIR.
  • The judges stated that mens rea is irrelevant at this stage and remarked that deletion of the post may aggravate and complicate the assessment.
  • The court adjourned the matter for two weeks and directed Additional Public Prosecutor Mankunwar Deshmukh to submit the case diary in a sealed cover.
  • Kondhwa police registered the FIR in May after the 19-year-old reshared content from the Instagram handle Reformistan that criticised the government’s role in post–Operation Sindoor tensions.
  • Earlier orders granted her bail, suspended the college’s rustication and allowed her to sit exams, with a later ruling setting aside the rustication for breach of natural justice.
