BOE Expands Basque Rent Caps to Astigarraga, Usurbil, Bilbao and Vitoria as Tool Launches

The Basque government has launched a portal that calculates capped rent ranges with legal review limits.

Overview

  • Spain’s Official State Gazette on 30 October formally added Astigarraga and Usurbil and included Bilbao and Vitoria as tensioned rental areas, taking full legal effect Friday, 31 October.
  • Reference indices in Gipuzkoa now apply in seven municipalities: San Sebastián, Irun, Errenteria, Lasarte-Oria, Zumaia, Astigarraga and Usurbil.
  • The caps apply to large landlords—owners of five or more homes in the designated area—and to dwellings entering or returning to the rental market after at least five years off, while active contracts keep their agreed rent.
  • The new website generates a permitted price band for each dwelling from inputs such as address, age, size, condition, elevator or parking, and it displays the maximum allowed contract revision.
  • The revision calculator uses the CPI formula for contracts signed before 26 May 2023 and the IRAV formula for later agreements, and 304 municipalities across Euskadi, Navarra, Galicia and Cataluña have been designated to date, with further additions in 2026 expected in Gipuzkoa including Hernani, Lezo, Arrasate, Zestoa and Tolosa.
