Berlin court rejects visa appeal of Afghan GIZ worker

  • The judges concluded that his 2021 Gefährdungsanzeige to the GIZ did not constitute a formal visa application under German law.
  • The court emphasized that admission of local staff must satisfy a statutory requirement to preserve Germany’s political interests, a determination reserved for the federal government.
  • Around 2,500 former Afghan local staff continue to wait in Pakistan for admission, while Germany has welcomed more than 36,300 Afghans since the Taliban takeover.
  • The OVG decision cannot be appealed further but allows for a complaint to the Federal Administrative Court.
