BCA Names Deputies and Man in Cass County Shooting, Leads Use-of-Force Review

Overview

  • State officials identified the deputies as Kaleb Cherne, with three years of experience, and David Donner, with six years.
  • Authorities said the man who died was 37-year-old James Weyaus of Onigum, who was pronounced dead at the scene.

  • The BCA reported an exchange of gunfire during the chase that left Cherne wounded in the leg before responding deputy Donner fatally shot Weyaus on the roadway.
  • Investigators recovered a 9mm handgun, a holster, and shell casings; body cameras captured portions of the incident, both deputies are on critical-incident leave, and Cherne has been released from a Fargo hospital.
