Batohi Refuses to Name Suspended Prosecutor in Public Hearing, Offers to Brief MPs in Camera

She argues that due process precludes public disclosure during an active Idac probe.

Overview

  • Members of Parliament, led by Julius Malema, castigated the NDPP for withholding the identity and questioned her fitness to continue in the role.
  • Batohi said intelligence from National Police Commissioner Fannie Masemola and Crime Intelligence head Dumisani Khumalo linked an NPA member to organised crime, which she formally referred to Idac.
  • She told the ad hoc committee she would consult counsel on providing names in a closed session and stressed she was not protecting any individual.
  • Testifying that South Africa is not winning against organised crime, Batohi cited poor intelligence, capacity shortages and corruption as key obstacles to successful prosecutions.
  • She defended Idac’s arrest of Crime Intelligence head Dumisani Khumalo and confirmed the review of the Phala Phala non-prosecution decision is still under consideration by specialist units.
