Barstool Sports Sues Omega Accounting, O’Brien for More Than $4.2 Million in Unpaid Ads

The case, filed in Manhattan federal court, is assigned to Judge Alvin K. Hellerstein with responses expected in the coming weeks.

Overview

  • Barstool alleges Omega Accounting Solutions and agency O’Brien Sales & Marketing failed to pay under a $6 million sponsorship and media-buy agreement negotiated after an initial $300,000 placement.
  • The deal positioned Omega as a marquee partner across Barstool properties, including the Barstool Sports Arizona Bowl, Rough N’ Rowdy, Super Bowl and March Madness programming, and placements on Pardon My Take.
  • Barstool says it performed its obligations and sent invoices totaling about $4.7 million for services from September through December 2022, followed by months of collection efforts.
  • The complaint claims O’Brien wired Omega $1.8 million in February 2023 but paid Barstool about $426,000, leaving alleged balances of over $3.2 million owed by Omega and about $1.08 million by O’Brien.
  • Barstool seeks more than $4.2 million plus interest, and the filing notes promotional efforts such as featuring Omega CEO Jay Woods on a Barstool podcast; representatives for the parties did not immediately comment.
