Bangladesh Court Declares Six as Indian Citizens, Sets Oct. 23 Charge Hearing

Their return hinges on identity checks and diplomatic coordination despite a Calcutta High Court order directing the Centre to bring them back.

Overview

  • A senior judicial magistrate in Chapainawabganj ruled in late September/early October that the two Birbhum families are Indian citizens and sent the order to the Indian High Commission in Dhaka for repatriation steps.
  • The group— including a near‑term pregnant woman, her husband and child, and another mother with two children—say they were detained in Delhi in June and pushed across the India–Bangladesh border before being jailed under Bangladesh’s Control of Entry Act, 1952.
  • The Calcutta High Court on September 26 set aside the Centre’s deportation decision, called the pushback illegal, and directed that all six be brought back within four weeks, rejecting a request for a stay.
  • Bangladesh’s top prosecutor in Chapainawabganj said a hearing to frame charges is scheduled for October 23 and indicated that guilty pleas could facilitate repatriation, while denying reports that a court asked Dhaka’s deputy high commission in Kolkata to act.
  • Indian officials note that Aadhaar is not conclusive proof of citizenship and say repatriation will require verification, consular processing, and BSF–BGB coordination as concerns grow for the detainees’ welfare.
