Autopsy and Video Show Rodriguez’s Fatal Shot Came From His Own Gun, JSO Says

Independent reviews by the State Attorney’s Office are underway.

Overview

  • An autopsy found Daniel Rodriguez, 34, died from a contact .40-caliber gunshot under his jaw, with the bullet matching his handgun rather than officers’ 9 mm weapons.
  • Bodycam video shows Rodriguez pulling a handgun during a domestic-dispute response, firing once as officers struggled with him, and then being shot, with officers providing aid and a second gun later found on him.
  • JSO also released footage from a separate Jan. 5 case showing 68-year-old Ofero Manalon pick up and point a rifle at officers in an Arlington garage, prompting police gunfire and a barricade.
  • SWAT used tear gas and a K-9 to take Manalon into custody after about three hours; he was hospitalized in stable condition and later jailed on aggravated assault on an officer and felon-in-possession charges with $1.25 million bail.
  • Both incidents will receive independent criminal reviews by prosecutors before JSO conducts its internal policy assessments.
