The lawsuit was filed on the three-year anniversary of the January 6 Capitol riot by Trump supporters.
Babbitt was shot by Capitol Police Officer Lt. Michael Byrd, who was protecting members of Congress during the riot.
Previous investigations by the Capitol Police and federal prosecutors found no wrongdoing by Byrd.
The lawsuit is being represented by attorneys for the right-wing watchdog group Judicial Watch.
