Arizona Judge Issues Injunction Halting Deportation of Unaccompanied Guatemalan and Honduran Children

The judge extended an earlier pause, citing a lack of clear parental coordination.

Overview

  • U.S. District Judge Rosemary Márquez granted a preliminary injunction on Sept. 25–26 that bars the immediate removal of the children.
  • The order prevents repatriation of any plaintiff without a valid voluntary departure order or a removal order from an immigration judge.
  • Márquez wrote that the government could not identify a single instance of coordination with a parent or any government, calling reunification claims dangerously unclear.
  • The suit, filed by the Florence Immigrant & Refugee Rights Project, covers 57 Guatemalan and 12 Honduran children ages 3 to 17.
  • The move follows late‑August attempts that brought children to planes in Texas, and a related D.C. case also blocked similar deportations as the administration characterizes the effort as family reunification.
