Overview
- Decree 796/2026 was published in the Boletín Oficial on Wednesday and formally replaces Article 28 of Law 24.449 to set new homologation and safety rules for new production and 0 km vehicles.
- The Secretaría de Industria, Comercio y de la Pequeña y Mediana Empresa will issue the Licencia de Configuración de Modelo (LCM) and the Secretaría de Turismo, Ambiente y Deportes will issue the Licencia de Configuración Ambiental (LCA), with both agencies and the Secretaría de Transporte given inspection and sanction powers.
- Manufacturers and importers must file a sworn declaration and the documents listed in Anexo P to obtain LCM and LCA, proving each model meets active and passive safety requirements and environmental limits.
- The text allows recognition of certain international certifications — including the NHTSA Blue Ribbon Letter — only when the certification, brand, model and VIN match, and requires immediate reporting to Argentine authorities of foreign recalls or investigations.
- Components and spare parts may be produced and imported freely without prior authorization, but firms remain legally responsible for meeting Anexo C technical specs, a change that could speed market entry while concentrating compliance risk on manufacturers and importers.
