Overview
- The Executive published Decrees 407/2026, 408/2026 and 409/2026 on Tuesday formalizing detailed controls for medical leave under the Labor Modernization Law.
- All medical prescriptions ordering work rest must be issued electronically through platforms registered in the National Registry of Digital Health Platforms (ReNaPDIS) and signed by professionals listed in the Federal Health Professional Registry (REFEPS).
- Digital medical certificates must state a full medical diagnosis, the prescribed treatment and the exact number of rest days to be valid for work absences.
- Employers keep the right to carry out health checks with their own doctors, and either party can request an official medical board or recognized public or private institute when diagnoses cannot be reconciled.
- The measures form part of a wider push to digitalize labor administration, affect how doctors, employers and workers document sick leave, and may require new platform registrations and ANSES IT upgrades to work in practice.
