Argentina Promulgates Disability Emergency Law but Freezes Implementation for Lack of Funds

Citing budget rules that require specified financing, the decree delays execution until Congress sets resources in the 2026 budget.

Overview

  • Decree 681/2025 promulgates Law 27.793 and suspends its execution under articles 5 of Law 24.629 and 38 of Law 24.156 until funding sources are defined.
  • The Executive estimates the measure would require about $3.02 billones for 2025–2026, roughly 0.35% of GDP, including PNC, Incluir Salud, and provider compensations.
  • Following a prior veto, Congress overrode the decision with two‑thirds majorities in both chambers, which compelled promulgation and shifted the debate to the budget process.
  • Through Decisión Administrativa 24/2025, the government reassigned $121.363.881.238 to ANDIS to update provider rates starting October 1, financed by reducing Treasury obligations.
  • Until credits are approved, new and converted disability pensions, compensations to providers, Incluir Salud expansions, and ANDIS operational deployments remain on hold.
