Argentina Enacts DNU Overhauling Intelligence Law, Expanding SIDE Powers to Permit Limited Detentions

Opposition parties moved to trigger congressional review of the measure over civil‑liberties concerns.

Overview

  • Decree 941/2025 was published in the Boletín Oficial, immediately amending Law 25.520 and centralizing strategic direction, budgets and reserved funds under the SIDE.
  • All intelligence activities are now classified as covert, and agents may apprehend people by judicial order or in cases of flagrancy with immediate notification to the competent security forces.
  • The overhaul renames and restructures key organs, creating the Agencia Nacional de Contrainteligencia and the Agencia Federal de Ciberinteligencia, and establishing a National Cybersecurity Center under the Cabinet.
  • The reform dissolves the National Directorate of Strategic Military Intelligence and transfers military strategic intelligence to the Armed Forces’ Joint Chiefs to reduce overlaps.
  • The government framed the package as modernization and rationalization, while opposition blocs sought Bicameral Commission review with an eye to challenging or annulling the decree.
