Argentina and Peru Courts Impose Custody in Separate Sexual-Abuse Cases Involving Minors

Both rulings signal a stricter judicial posture on sexual violence against minors.

Overview

  • In San Pedro de Jujuy, a provincial tribunal sentenced a man to six years for two counts of simple sexual abuse aggravated by kinship and cohabitation against his minor daughter.
  • The court acquitted him of other alleged offenses related to sexual abuse and promotion of corruption of minors by granting the benefit of the doubt.
  • Judges ordered his continued incarceration, barred any form of contact with the victim, and directed that his genetic profile be added to the national registry once the ruling is final.
  • In Maynas, Loreto, Peru, the Third Investigative Court ordered four months of pretrial detention for S.J.R.B. (17) over the alleged rape of V.A.D.D. (16) in a state of unconsciousness or inability to resist.
  • The Peruvian court also referred potential prosecutorial negligence to the ANC after noting an additional minor at the residence, and the investigation continues.
