ARCA Rules Take Effect for Employer Debt Amnesty to Formalize Unregistered Workers

The PER offers large debt cuts plus payment plans to push private firms to register workers and limit some penalties.

Overview

  • ARCA formalized the Régimen de Promoción del Empleo Registrado by publishing Resolución General 5862/2026 on Thursday and said the agency’s online systems will open on June 16 with a November 28, 2026 adhesion deadline.
  • Private employers may regularize employment relationships that began on or before March 5, 2026 and are active at the time of adhesion; public-sector employers and cases already regularized under earlier schemes are excluded.
  • The resolution sets tiered condonations on social-security capital and interest—90% for micro and small firms and non-profits, 80% for mid-sized firms, and 70% for other employers—and fully pardons debts tied to health insurance, work-risk insurance, and mandatory group life insurance.
  • Unforgiven balances can be paid in cash with an extra 50% reduction or financed under ARCA plans at 1% monthly interest with maximum terms of 72, 48 or 36 monthly installments depending on employer category and minimum upfront payments.
  • Most outlets report the official terms above but one publication offered a differing set of discounts and shorter installment caps that contradict the text of RG 5862/2026, creating a noted discrepancy in media accounts.
