Appellate Prosecutor Seeks to Vacate Alberto Fernández’s Procesamiento in ‘Seguros’ Case

Sala II will rule after the remaining hearings on a bid to replace the processing order with falta de mérito pending new forensic tests.

  • Prosecutor José Luis Agüero Iturbe asked the Federal Chamber to revoke the July procesamiento of the former president and declare falta de mérito.
  • He requested fresh evidence steps, including forensic review of Fernández’s cellphone and tablet and testimony from former officials Santiago Cafiero and Vilma Ibarra.
  • He acknowledged indicios of involvement but said there is no direct proof sufficient to sustain the charge at this stage.
  • He also urged lifting measures imposed by Judge Sebastián Casanello, including the asset embargo and the ban on leaving the country.
  • The decision now rests with judges Eduardo Farah, Martín Irurzun and Roberto Boico, who will rule after hearings with the remaining defendants conclude.
