Overview
- The Eleventh Circuit found undue delay by U.S. District Judge Aileen Cannon in addressing bids to release remaining portions of Jack Smith’s report on President Trump’s classified-documents investigation.
 - Petitions for writs of mandamus were held in abeyance for 60 days to allow the district court to fully resolve the pending motions.
 - The court noted that motions to intervene were filed on February 14 and February 24, 2025, and that the district court was notified on July 7 and July 10 that briefing had been complete for more than 90 days with no action taken.
 - The Knight First Amendment Institute and American Oversight, which sought the report’s release, argued the public has a right to see it and urged immediate posting on the docket.
 - Judge Cannon previously barred disclosure of the report in January and earlier presided over the Smith case, later dismissing his indictments against President Trump after the Supreme Court’s immunity ruling.
