Overview

  • DHS announced in May that TPS for about 11,700 Afghans would expire on July 14 based on its assessment that conditions in Afghanistan had improved.
  • On July 14, immigration advocacy group CASA filed an emergency motion in the Fourth Circuit arguing that the termination jeopardized beneficiaries’ safety.
  • The appeals court’s unsigned order maintains TPS for Afghans until July 21 and has ordered both sides to submit briefs in the coming days.
  • TPS allows beneficiaries to live and work legally in the U.S. and protects them from deportation but offers no pathway to U.S. citizenship.
  • Advocates warn that many Afghans who assisted U.S. forces face severe reprisals under Taliban rule and are calling on Congress for permanent protections.
