Appeals Court Orders Gloucester County to Reprint In-Person Ballots Before Early Voting

The panel said state law leaves no discretion to depart from the party-column format.

Overview

  • A New Jersey appellate panel reversed a lower court and mandated corrected party-column ballots for in-person voting in Gloucester County.
  • Mail ballots already sent in an office-block layout will not be replaced, with reprints limited to in-person ballots for the Oct. 25 start of early voting.
  • Judges found the clerk’s office-block design violated statutes and concluded county clerks cannot deviate from the required column arrangement.
  • The case was brought by Gloucester County Republicans with support from the Republican National Committee and targeted Clerk James Hogan’s redesign.
  • In an earlier order, Superior Court Judge Benjamin Telsey required the county to reimburse Republicans $26,007 for campaign materials affected by the unlawful design.
