Appeals Court Blocks Chicago Check-Ins as Portland Guard Trial Opens With DOJ Admission

  • The 7th Circuit issued a one-page order suspending Judge Sara Ellis’s requirement that Border Patrol Commander Gregory Bovino brief her daily on Chicago enforcement actions.
  • Ellis’s other directives remain in force, including a body-camera mandate and production of use-of-force reports dating to Sept. 2, with Bovino ordered to complete camera training by Friday.
  • At the Portland trial, DOJ lawyer Jean Lin disclosed that Oregon National Guard troops were sent to the city’s ICE facility between Oct. 4 and Oct. 5 despite a temporary restraining order; Judge Karin Immergut said the question of contempt would be addressed later.
  • The 9th Circuit vacated an earlier panel ruling and agreed to rehear the National Guard case en banc, leaving any Portland deployment on hold.
  • In a separate filing, the Supreme Court requested additional briefing on the administration’s bid to deploy the Guard in the Chicago area, indicating no action before Nov. 17.
