Overview

  • The proposal would require a Prime Minister, chief minister or minister detained for 30 consecutive days on a serious charge punishable by five years or more to vacate office absent judicial relief.
  • Shah said no one should govern from prison and stressed the provision applies to everyone, adding that courts decide bail and could provide relief within the 30-day window.
  • The bill has been sent to a Joint Parliamentary Committee for scrutiny, but parties including the RJD, TMC and AAP say they will not participate.
  • Arvind Kejriwal questioned why leaders who induct alleged criminals into their parties are not held similarly accountable, and Ashok Gehlot linked the timing to Rahul Gandhi’s Vote Adhikar Yatra.
  • Former Attorney General Mukul Rohatgi backed the measure as a step to clean up politics and argued that potential misuse can be checked by courts, while the amendment still needs two-thirds support in both Houses before any change takes effect.
