Ambala Commissioner Voids 2023 Order, Cancels Mutation in Panchkula Land Case

The case now returns to revenue authorities under High Court directions on surplus land.

Overview

  • On August 19, Ambala divisional commissioner Sanjeev Verma recalled predecessor Renu Phulia’s September 13, 2023 order that had lifted a 2003 stay on transactions for 14 acres in Beed Firozadi, Panchkula.
  • Verma found a conflict of interest, noting an agreement and payments beginning June 20, 2023 for a purchase by Phulia’s husband Satyavir Singh and son Neelanchal, predating the August 28, 2023 petition.
  • He held the 2023 order had no legal footing under Section 84 of the Punjab Tenancy Act read with Section 24 of the Punjab Security of Land Tenures Act because it was passed ex parte without hearing the state and without condoning a two-decade delay.
  • Mutation No. 148, sanctioned on March 20, 2024 on the strength of the recalled order and based on a 2003 gift deed, was ordered cancelled with directions to correct any subsequent Jamabandi entries.
  • Registration of transfer deeds was earlier stalled by the Financial Commissioner (Revenue) to avoid litigation as the Collector must redetermine surplus area under a February 24, 2023 Punjab and Haryana High Courtective.
