Allahabad High Court Bans Saliva-Stained Filings Over Hygiene Concerns

The judge issued the directive after finding “reddish” marks on more than ten petitions in one morning.

Overview

  • The Lucknow Bench directed the Senior Registrar and registry staff to refuse any petition, paper book or application that shows saliva spots.
  • The Government Advocate and Chief Standing Counsel were told to circulate written instructions so clerks, oath commissioners and office staff do not use saliva to turn pages.
  • Justice Shree Prakash Singh called the practice highly unhygienic and warned it poses an infection risk to anyone handling the papers.
  • The court noted the stains may have been applied during filing by clerks, oath commissioners or registry personnel and ordered careful checks at the point of acceptance.
  • While hearing a Bahraich land dispute, the court issued notice to the opposite parties and stayed both a December 20, 2022 SDM attachment order and a March 6, 2025 revisional order until the October listing.
