Abbott Signs Texas Law Requiring Birth-Sex Use of Bathrooms in Public Buildings

Civil-rights groups say the measure is discriminatory, with lawsuits expected before the Dec. 4 start date.

Overview

  • Senate Bill 8 covers multi-occupancy restrooms, locker rooms, changing rooms and shower rooms in government-owned buildings, including public schools and universities.
  • The statute directs the Texas Department of Criminal Justice to house inmates by sex in correctional facilities.
  • Family violence shelters are barred from serving transgender women, except when the person is 17 or younger and the child of a woman receiving services.
  • Entities that violate the law face fines of $25,000 for a first offense and $125,000 for subsequent offenses, and complaints can prompt attorney general investigations.
  • Exceptions allow access for custodial and maintenance work, law enforcement and medical purposes, assisting an individual in need, and for adults accompanying children under 10.
