9th Circuit Rules California’s One-Gun-a-Month Law Unconstitutional

The three-judge panel said the restriction lacks a historical analogue under the Supreme Court’s Bruen framework

Overview

  • The 9th Circuit unanimously upheld Judge William Hayes’s March ruling that California’s 30-day purchase cap violates the Second Amendment.
  • Judge Danielle Forrest, joined by Judges Bridget Bade and John Owens, found no historical precedent for limiting firearm acquisitions to one every 30 days.
  • The court applied the Supreme Court’s 2022 Bruen decision, which requires modern gun laws to align with the nation’s historical tradition of firearm regulation.
  • Originally enacted in 1999 for handguns and expanded to all firearms last year, the law was challenged by gun owners, retailers and advocacy groups as an arbitrary restriction.
  • California’s attorney general has not indicated whether the state will seek an en banc rehearing or appeal the decision to the Supreme Court.
