71-Year-Old Killed in California DUI Hit-and-Run, Suspect With Prior Deportation Order Arrested

ICE now seeks custody through a detainer following the arrest.

  • Deputies say Barry William Tutt, 71, was struck in Dana Point on Nov. 7 and later died at a hospital.
  • Witnesses reported a silver Ford fleeing the scene, and investigators identified the driver as 57-year-old Humberto Munoz Gatica of Laguna Niguel.
  • He was arrested the next day and booked on suspicion of DUI causing death or bodily injury and hit-and-run causing death or bodily injury, according to jail records.
  • ICE and DHS officials say Munoz Gatica overstayed a 2008 visa, was arrested by ICE in 2011, failed to appear in immigration court, and was ordered deported in absentia in 2012.
