2nd Circuit Refuses En Banc Rehearing of Trump’s Carroll $5 Million Verdict

The ruling ends his final appeals court option, directing the case to the Supreme Court for review.

Overview

  • A Manhattan jury in May 2023 found President Trump liable for sexually abusing and defaming writer E. Jean Carroll, awarding her $5 million in damages.
  • Trump contended the trial was tainted by admission of the 2005 “Access Hollywood” tape and testimony from other women who accused him of misconduct.
  • In December, a three-judge panel of the 2nd U.S. Circuit unanimously upheld the verdict and rejected all of Trump’s evidentiary objections.
  • On June 13, the full 2nd Circuit declined by an 8–2 vote to rehear the appeal en banc, with two Trump-appointed judges dissenting over the use of character evidence.
