16 States and D.C. Sue Trump Administration Over Freeze of EV Charger Grants

The multistate suit asks a federal judge to order USDOT to resume CFI and Accelerator disbursements paused since spring for what plaintiffs call unlawful impoundment.

Overview

  • Filed in the U.S. District Court for the Western District of Washington, the case is led by California and Colorado with support from 14 other states, the District of Columbia, and Pennsylvania’s governor.
  • The challenge targets the Charging and Fueling Infrastructure program and the EV Charger Reliability and Accessibility Accelerator, with roughly $1.8 billion and about $350 million at stake, respectively.
  • Plaintiffs say USDOT and FHWA have refused to approve new obligations under both programs since spring 2025 without public explanation, halting projects and creating financial uncertainty.
  • California reports about $179.8 million in threatened awards, including $59.3 million for freight-corridor charging, $55.9 million for zero-emission freight routes, and $63.1 million for charger repairs.
  • Environmental groups filed a separate lawsuit focused on CFI, citing over 140 promised grants totaling nearly $1.8 billion, while an earlier NEVI case saw a judge order much of that separate funding released.
