13th Salary First Installment Was Due Friday in Brazil—What To Do If It Didn’t Arrive

Workers can escalate from HR to unions and labor authorities to secure corrected payment if the deposit was missed.

  • By law, the first portion had to be paid by November 30 but was advanced to Friday, November 28, since the deadline fell on a Sunday, according to the Labor Ministry.
  • The benefit covers CLT employees, domestic and rural workers, avulsos, public servants and INSS retirees and pensioners, with months counted if at least 15 days were worked.
  • The initial deposit typically equals half of the gross 13th with no deductions, while the second installment includes INSS and income tax.
  • If the money didn’t post, experts advise contacting HR first, then the union, and filing complaints with the Labor Ministry or MPT; employers may face fines, and courts can order payment with interest, monetary correction and possible moral damages.
  • The second installment is due by December 20 and, because it falls on a Saturday in 2025, many payrolls are expected to credit it on Friday, December 19.
